These SMS Terms and Conditions govern one-to-one text message communications between Monark and individuals who have agreed to communicate with a Monark employee by SMS.
By opting in to or using Monark’s SMS messaging service, you acknowledge and agree to these SMS Terms and Conditions and our Privacy Policy.
1. About the SMS Service
Monark uses SMS to support low-volume, one-to-one business conversations between individually assigned Monark employees and existing or prospective business contacts.
Recipients may include clients, vendors, service providers, business partners, job candidates, and individuals who have contacted Monark regarding a legitimate business matter.
Messages may include:
Monark’s Microsoft Teams SMS service is not used for advertising, promotional campaigns, bulk messaging, automated alerts, purchased contact lists, or API-generated communications.
2. Consent to Receive SMS Messages
You may consent to receive SMS messages from Monark by:
Consent applies to one-to-one business communications with the applicable Monark employee and their assigned business phone number.
Consent to receive SMS messages is not a condition of purchasing or receiving any product or service from Monark.
3. Message Frequency
Message frequency varies depending on the nature and duration of the business conversation.
Because this service is used for person-to-person communication, the number of messages received will depend on your interactions with the applicable Monark employee. Message frequency varies.
4. Message and Data Rates
Monark does not separately charge recipients for participating in its SMS messaging service.
However, standard message and data rates may apply depending on your mobile carrier and service plan. You are responsible for any charges imposed by your mobile carrier. Message and data rates may apply.
5. Opting Out
You may stop receiving SMS messages from a Monark employee’s business phone number at any time by replying with any of the following supported keywords:
STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE
After submitting an opt-out request, you may receive one final SMS message confirming that you have been unsubscribed. No further messages will be sent from that Monark number unless you subsequently provide consent and reply START to resume the conversation.
Because Monark’s SMS service is used for one-to-one conversations, an opt-out request applies to the specific conversation and Monark phone number from which the messages were sent.
Monark will not attempt to bypass an opt-out request by contacting you from another SMS-enabled number without separate consent.
6. Resuming SMS Messages
After opting out, you may resume receiving SMS messages from the applicable Monark number by replying: START

8. Privacy and Use of Information
Monark respects your privacy. Information provided through the SMS service is used to deliver messages, respond to you, maintain appropriate business records, and support the relevant business conversation.
Information may be processed by Microsoft, mobile carriers, telecommunications providers, and other service providers that assist with delivering SMS messages.
Mobile telephone numbers, SMS consent records, mobile opt-in information, and text messaging originator consent data will not be shared with third parties or affiliates for marketing or promotional purposes.

9. Availability and Delivery
SMS delivery is subject to mobile carrier availability, network conditions, device compatibility, and other factors outside Monark’s control.
Monark does not guarantee that every SMS message will be delivered or received within a particular period.
SMS should not be used to communicate urgent, emergency, or time-sensitive matters. In an emergency, contact the appropriate emergency service directly.
10. Acceptable Use
Recipients must not use Monark’s SMS service to transmit content that is unlawful, fraudulent, threatening, abusive, defamatory, harmful, or otherwise inappropriate.
Monark may suspend or discontinue an SMS conversation when reasonably necessary to protect its employees, systems, business operations, or legal interests.
11. Changes to These Terms
Monark may update these SMS Terms and Conditions periodically to reflect changes in its services, legal obligations, carrier requirements, or business practices.
The updated version will be published on this page with a revised effective date. Continued use of the SMS service after an update constitutes acceptance of the revised terms.
